These Terms of Use (TOU) and Terms of Sale (TOS) of CodeWeb – JordanDev govern access, use, and purchases on the codeweb.app platform. These conditions cover platform access rules, usage terms, and conditions for acquiring digital content and subscriptions. By accessing or using our platform, you expressly agree to all of these TOU/TOS. If you do not agree to these conditions, you must not use our platform.
Preamble: Limitation of Liability and Force Majeure
CodeWeb strives to provide a reliable and accessible platform. However, CodeWeb cannot be held responsible for: (1) temporary interruptions, maintenance, technical failures, or service unavailability beyond its control; (2) indirect damages (data loss, financial loss, business interruption) resulting from use or inability to use the platform. In case of force majeure events as defined in Article 1218 of the French Civil Code (natural disaster, strike, conflict, epidemic, etc.), no party can be held responsible for failure to perform its obligations.
Article 1: Purpose
These TOU define the conditions of access and use of services offered on the codeweb.app platform. CodeWeb notably provides digital educational content (complete courses, practical tutorials), project showcases, Premium subscriptions, and any other services or additional products that may be added to the platform in the future in the fields of web development and related technologies.
Article 2: Access and Registration
Access to certain sections of the platform requires the creation of a user account.
- Registration: You can register using your email address, Google, or GitHub account.
- Account Creation: Creating an account requires providing accurate and complete personal information. You agree to provide accurate information during registration and to keep it up to date.
- Security: While CodeWeb does not store passwords, you are responsible for managing your credentials (email, Google, GitHub). You must ensure their confidentiality and notify us immediately of any unauthorized use of your account.
- 2.4 Personal Data Protection: Personal data collected during account creation (name, email, payment information) is used solely for account management and is never sold to third parties. Data is processed in accordance with the General Data Protection Regulation (GDPR). You have rights to access, rectify, and delete your personal data.
Article 3: Access to the Platform
The codeweb.app platform is freely accessible to any user with an internet connection. However, certain training courses and features are only available to users who have purchased a paid product. CodeWeb strives to ensure continuous platform availability but cannot be held responsible for temporary interruptions, maintenance, technical failures, or service unavailability beyond its control.
Article 4: Purchase Conditions and Product Access
The products and services offered on codeweb.app include:
- 4.1 One-time purchase products: Complete courses (Courses), Practical tutorials (Tutorials) and Project showcases (ProjectShowcases). Once purchased, the user has unlimited access to the content.
- 4.2 Premium Subscription: Monthly or annual access to all Premium tutorials. Automatic renewal unless canceled. Possibility to cancel at any time from your account. In case of cancellation, access is maintained until the end of the paid period.
- 4.3 Downloads: Downloaded files (source code, resources) remain accessible during the validity period of your purchase or subscription. Download history is kept for 6 months for security reasons and protection against disputes.
- 4.4 Payment Methods: Payments are processed securely through Stripe. No banking data is stored by CodeWeb. You are responsible for the validity and security of payment information provided. Consult Stripe's privacy policy for more information: https://stripe.com/privacy
- 4.5 Right of Withdrawal and Waiver: In accordance with Article L221-28 of the Consumer Code, the 14-day right of withdrawal does not apply to digital content whose performance has begun with your prior consent. Before any purchase, you are expressly informed of the loss of your right of withdrawal and must give explicit consent to this waiver. By accessing or using purchased content, you irrevocably waive your right of withdrawal.
Article 5: Intellectual Property
All content on the platform (texts, videos, code, visuals, etc.) is the exclusive property of CodeWeb or its partners and protected by intellectual property law. No reproduction, distribution, reuse, modification, or partial or total adaptation is allowed without prior express written authorization from CodeWeb. Any violation may result in: (1) immediate account suspension; (2) civil and criminal prosecution under Articles L335-2 et seq. of the Intellectual Property Code; (3) claim for damages.
Article 6: Cookies
To enhance the user experience and facilitate access to platform features, CodeWeb uses cookies. These files placed on your computer allow us to identify you when you log in to the platform.
- Session cookies: These cookies allow users to stay logged in during a single day without having to re-authenticate.
- Analytics cookies: These cookies allow CodeWeb to analyze user activity on the platform (number of pages viewed, visit frequency, etc.), notably through services like Google Analytics. These cookies are used solely to produce anonymous traffic statistics.
Users can disable cookies by adjusting their browser settings. Third-party cookies (notably Google Analytics) are subject to their own privacy policies. Article 7: User Responsibilities
You agree to comply with these Terms and to use the platform in accordance with applicable laws and regulations. You are specifically prohibited from: (1) using the platform for illegal purposes or contrary to public order; (2) disrupting the proper functioning of the platform; (3) attempting to access protected areas of the site or bypassing security measures; (4) extracting, scraping, or crawling site data without authorization; (5) using the platform for harassment, spam, or threats.
Article 8: Termination of the Contract
- 8.1 By the user: Any registered user can request the deletion of their account by emailing contact@codeweb.app. The termination will take effect within a maximum of fifteen (15) business days following receipt of the request.
- 8.2 By CodeWeb: CodeWeb reserves the right to suspend or terminate the user's access to all or part of the platform features, temporarily or permanently, in the event of a breach of these Terms or applicable laws. This termination will result in immediate account deletion. CodeWeb also reserves the right to terminate the contract, with one month's notice, for any legitimate reason, including without fault of the user.
- 8.3 Data Retention: In case of account deletion or contract termination, certain data necessary for compliance with legal obligations (invoicing, disputes, transaction evidence) may be retained temporarily, in accordance with applicable regulations and for the duration required by law.
Article 9: Changes to the Terms
CodeWeb reserves the right to modify or adapt these Terms at any time. In case of substantial modification, you will be informed by email or via a notification on the platform. The changes will take effect upon publication on the website. Users are deemed to have accepted the new Terms if they continue using the platform after the modifications are published. If you do not accept the modifications, you must stop using the platform.
Article 10: Governing Law and Dispute Resolution
These Terms are governed by French law, regardless of where the platform is used. In the event of a dispute, the parties will seek an amicable solution. Failing that, any dispute shall be subject to the competent courts located in the jurisdiction of CodeWeb's registered office, situated in Houdain (62150), France. French law alone applies, even in the event of use of the site from another country or jurisdiction.
Article 11: Premium Subscription
CodeWeb offers a Premium subscription whose features are described on the platform. Users can choose their subscription according to their needs.
- 11.1 Subscription Types: The Premium subscription is available with monthly or annual billing, according to user preference. The annual subscription generally benefits from a preferential rate.
- 11.2 Renewal and Cancellation: The subscription is automatically renewed for the same period unless canceled by the user. Users can cancel their subscription at any time from their account. Cancellation will take effect at the end of the current subscription period, with no refund for the current period.
- 11.3 Payment: Subscription payment is made by automatic debit via Stripe, according to the chosen frequency. Users agree to provide valid and up-to-date banking information.
- 11.4 Suspension for Non-Payment: In case of non-payment, CodeWeb reserves the right to suspend Premium access and terminate the subscription in accordance with Article 8.
- 11.5 Price Changes: Prices are indicated in euros (EUR) including tax (VAT), excluding any banking or currency conversion fees applied by your bank or payment processor. Applicable prices are those in effect at the time of subscription. Any price change will be communicated at least one month before implementation. Modified prices will apply at the next billing date unless canceled beforehand.
- 11.6 Refund Policy: Refund conditions are detailed in our Refund Policy available on the platform.
Article 12: Refund Policy
Purchases made on the codeweb.app platform are subject to specific refund conditions. In accordance with applicable regulations, except as otherwise provided in the Refund Policy, no refund will be made once the digital content is accessible to the user. Article 13: Personal Data Protection
Personal data collected during registration and use of the site (name, email, payment information) is processed in accordance with the General Data Protection Regulation (GDPR) and our Privacy Policy, available on the platform. You have the right to access, rectify, delete, and object to the processing of your personal data.
